1. Acceptance of Terms

By accessing and using the services provided by White Caps Development ("we", "our", or "us"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

White Caps Development provides Shopify store optimization services, including but not limited to:

• Speed optimization and performance improvements
• Conversion rate optimization (CRO)
• Custom Shopify development
• Store audits and consultations
• Technical support and maintenance

3. Service Agreement

When you engage our services, you agree to:

• Provide accurate and complete information about your Shopify store
• Grant necessary access permissions for us to perform the requested services
• Respond to our requests for information in a timely manner
• Review and approve any major changes before implementation
• Make payment according to the agreed terms

4. Payment Terms

Payment terms will be specified in your individual service agreement. Generally:

• Payment is due according to the schedule outlined in your service agreement
• Late payments may result in service suspension
• Refunds are handled on a case-by-case basis as outlined in your service agreement
• All prices are in USD unless otherwise specified

5. Intellectual Property

All custom code, designs, and implementations created specifically for your project become your property upon full payment. However, we retain the right to use general methodologies, techniques, and non-proprietary knowledge gained from our work for future projects.

6. Confidentiality

We respect the confidentiality of your business information and will not disclose any proprietary information to third parties without your explicit consent, except as required by law.

7. Limitation of Liability

While we strive to provide high-quality services, we cannot guarantee specific results such as increased sales or conversion rates. Our liability is limited to the amount paid for our services. We are not responsible for any indirect, incidental, or consequential damages.

8. Service Availability

We aim to provide reliable service but cannot guarantee 100% uptime. We will make reasonable efforts to notify you of any planned maintenance that may affect your store.

9. Termination

Either party may terminate the service agreement with written notice. Upon termination, you remain responsible for payment of all services rendered up to the termination date.

10. Data Protection

We handle your data in accordance with our Privacy Policy and applicable data protection laws. We implement appropriate security measures to protect your information.

11. Modifications to Terms

We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our services after changes constitutes acceptance of the new terms.

12. Governing Law

These terms are governed by the laws of Nevada, United States. Any disputes will be resolved in the courts of Nevada.

13. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable.
